Customer Terms and Conditions

The terms and conditions set out the terms of the contract between Unit Marketing Solutions Pvt. Ltd. and each member.

I Definitions

In these terms and conditions, unless the context specifies otherwise: UNIT shall mean Unit Marketing Solutions Pvt. Ltd. and shall include its successors, assigns, representatives and transferees.

MCC means the Mumbai Community Card customer rewards program, managed and operated by UNIT offering privileges to members of the program, whereby certain MCC points are accumulated on every earn activity for transactions made by members within MCC Merchant Partner network & such MCC points may be used by the member for redemption using options provided by MCC from time to time.

Member means any individual who is resident of India and aged 18 years or over, who possesses an active mobile phone number and is enrolled as a member of MCC holding a valid MCC card/membership no.

Primary member is the member who owns the Mumbai community card membership account and controls all redemptions on it as well. Card held by the primary member is known as the primary card.

Secondary/Add-on members are additional cardholders on primary members' account.

MCC Card means a MCC rewards program card. This card shall be a property of UNIT.

Points is the unit currency for the program. Members are awarded MCC points for earn activities within the network.

Merchant Partner means any or all of the present or future entities, merchants, shops, departmental stores, restaurants and other participating establishments, whether with online or offline presence, in agreement with UNIT, where members can accumulate Mumbai community card points for purchase of goods and services.

Earn activity means any activity, which results in accruing of MCC points to a member as specified in clause V.

Redemption means any activity, which results in exchange of MCC points by a member for rewards, as specified in clause VII.

Rewards means the periodical redemption reward options provided by UNIT to the program members.

II General Conditions

1. We would like to use your personal details, plus details on how you use your MCC card to: Help manage MCC and improve the way we run it. Understand your shopping habits to improve our service. Unless you indicate otherwise, contact you with offers and information about products and services of interest to you and your family.

2. Membership into MCC is voluntary, open to residents of India with a valid mobile number in India, above the age of 18 and eligible as per the rules laid down by UNIT.

3. MCC membership enrollment and eligibility, earning MCC points, claiming MCC rewards, availability of MCC rewards and redemption are subject to the terms and conditions herein and are subject to any applicable laws and regulations.

4. A MCC membership is valid for lifetime of the member unless terminated in terms thereof.

5. A MCC card is not a credit card or a debit card or a discount card or a prepaid card. It is not a payment instrument.

6. MCC membership, MCC card and MCC points are non-transferable except as specified.

7. Members will be personally liable for any and all costs, taxes, charges, claims or liabilities of whatever nature arising from the provision or availability of benefits, facilities or arrangements provided or made available to a member, by an MCC merchant, as a result of his/her membership.

8. MCC card at all times remains the property of UNIT, which reserves the right at any time in its absolute discretion and without giving notice to such member to withdraw the membership and benefits arising out of the same. The member must return or destroy his/her MCC card without delay whenever requested by UNIT.

9. UNIT will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision whether whole or part, of any such services, benefits, facilities or arrangements.

10. When a member seeks to use or obtain any of the product or services offered by the MCC merchants, the use of such products and services will be subject to the terms and conditions of the provider of the products and services.

11. The program of MCC may be modified at the sole discretion of UNIT from time to time without intimation to the member.

12. UNIT shall not be liable in the event it fails to fulfill any of its obligation under this agreement due to flood, earthquake, storm, cyclone or any other acts of god of similar nature, war strike, lockout, or governmental or judicial or quasi-judicial policies/intervention/direction /prohibition or change in law or for any other reasons beyond its control.

13. A waiver of any of the terms and conditions by UNIT shall not be deemed to be a permanent waiver, but shall apply instances to which the waiver is allowed.

14. MCC shall be serviced and accepted only at locations specified by MCC. MCC can at any time without intimation to the customer add and / or delete merchants. The same shall be updated on the website within a reasonable time.

15. Members are required to inform mobile number changes to UNIT immediately.

16. UNIT will not be responsible for non-serviceability due to member moving out of serviced areas.

17. UNIT at any time, without giving notice, change, modify and/or vary the terms and conditions of MCC.

III Enrolment in MCC

1. It is the members' responsibility to share the correct communication details with MCC.

2. Customers can enroll into MCC program through mediums specified by MCC from time to time.

3. Only one MCC card (implying one primary membership) per individual will be accepted.

4. If a member has been issued more than one primary MCC, it is the duty of such member to inform UNIT immediately and request for an account aggregation.

5. Membership to MCC is at the sole discretion of UNIT and it may refuse membership to any applicant without assigning any reasons.

IV Use of MCC card and membership

1. The member agrees that by registering he/she has read and understood the prevailing terms and conditions of MCC and confirms that he/she is bound by such terms and conditions.

2. UNIT shall not be liable for any loss or damage, whether direct or indirect, resulting from termination or change of MCC or any of its facilities, benefits or arrangements which are made available to members, including without limitation, MCC merchant's withdrawal or the withdrawal or limiting of any such services, benefits or facilities.

3. If any member loses the MCC card, the member must inform UNIT immediately. Till such time the loss has been reported to UNIT, UNIT shall not be liable for any losses incurred by misuse of such MCC card. A new MCC card after blocking and cancellation of the old MCC card will be issued to such member on payment of specified charges. All unredeemed MCC points on the old MCC card will be transferred to the new MCC card. Once a card is reported lost, it will be blocked and under any circumstances it will not be unblocked.

V MCC points

1. Members can accrue MCC points through a transaction with MCC merchant for the purchase of goods or services paid by means of payment agreed upon by the MCC merchant.

2. Members will also be awarded MCC points for non-transactional activities as communicated from time to time.

3. MCC points awarded may vary between different MCC merchants depending on the arrangement UNIT has with the merchant.

4. To accrue MCC points, the member must present his/her MCC card or MCC number or registered mobile number at the time of completing the earn activity. If a member fails to present the MCC card, registered mobile number or MCC card number when availing such services, this may result in the applicable MCC points not being accrued by the members and UNIT or its MCC merchant shall not be responsible in this regard.

5. The method of earning MCC points from MCC merchants is subject to change from time to time.

6. MCC merchants may change any of the terms and conditions of their business at any time without notice to the MCC member or to MCC program. UNIT is not responsible for informing members of any such changes.

7. MCC points accrued through transactions at MCC merchants shall be credited to member's account within 10 working days.

8. MCC points accrued through any other earn activity shall be credited to member's account within such period as is mentioned for such activity.

9. MCC points credit is not applicable for the following: (i) returned & refunded goods and services, forfeited and unused services. (ii) goods or services acquired by using MCC points.

10. MCC points are valid for a period of one year or any other notified date. Points earned during any month of the year shall expire (on FIFO basis) on completion of one year from the end of the month. Thus points earned during 1st March 2010 to 31st March 2010 shall get expired on 1st April 2011.

11. In the event of the member not using his/her MCC card to accumulate and/ or redeem MCC points for a continuous period of 24 months (2 years), the accumulated MCC points and the MCC membership account will expire. All points accumulated on such accounts and lying unused at the time of expiry shall lapse.

12. In case of earn activity with any MCC merchants who participate in more than one program, subject to the consent of the MCC merchants, the members are eligible for credit of points in more than one program.

13. Complaints on points not credited to account from any partner / merchant will be entertained only if the date of transaction is not older than 2 months.

14. MCC points are not negotiable, transferable or redeemable for cash. At no time may MCC points be credited to or MCC rewards request be issued to, purchased by, or sold to or otherwise transferred to any person other than the member. Any such MCC points or requests for MCC rewards are void if transferred for cash or other considerations. Any person who commits such acts is liable for damages, litigation and related costs to UNIT, which reserves the right, to terminate membership of such members from MCC.

VI MCC points update, program updates & notices

1. Members can call the MCC helpline nos. for obtaining an update of the MCC points accumulated and/or used for rewards or donations.

2. Any notice, information, intimation, change, modification, alteration of these terms and conditions or the program shall be deemed to have been given to the members forthwith when posted on the website.

3. Your MCC card cannot be used for any transaction where the beneficiary is a business and/or the owners of a business.

4. Charitable donations may vary between different MCC merchants and products depending on the arrangement MCC has with the merchant.

5. Charitable donations will be raised on every basic point earn MCC transaction. Charitable donations may or may not be raised on transactions which include promotional or redemption offers or options. This is at sole discretion of UNIT.

6. Charitable donations will be distributed among associated NGOs by UNIT depending upon terms & conditions between NGO and UNIT.

7. No receipts will be given for charitable funds raised through your regular transactions using MCC card at our merchant partners and MCC members cannot claim tax exemptions under income tax rules.

VII Redemption of MCC points

1. Points can be redeemed at specified MCC merchant partners only through vouchers or mobile coupons issued by the sole discretion of UNIT. Where Points are redeemed for a Voucher/mobile coupon carrying a specified cash discount or benefit, the Voucher/ mobile coupon will have an expiry date specified on it and will be subject to any other terms and conditions stated on the Voucher/mobile coupon or otherwise publicized.

2. MCC points can be redeemed against the MCC rewards catalog and other options provided by MCC and will be subject to any other terms and conditions stated on the product/voucher or otherwise publicized.

3. MCC points can also be redeemed to make donations to associated social causes as specified by MCC from time to time.

4. On receipt of the MCC rewards/donation request by UNIT through call center, website or otherwise, MCC points will automatically be deducted from the accumulated MCC points in the members account.

5. MCC points redeemed for rewards/donations once cannot be canceled or withdrawn or changed and the MCC points used for the same cannot be reversed. MCC rewards have no monetary refund value.

6. All the items featured in the MCC rewards catalog and/or informed by UNIT are subject to availability and suppliers warranties and restrictions at the time of claiming the MCC rewards.

7. If a member has not given correct address or is not available at the mentioned address at the time of delivery, product will be delivered to the person available at the given address.

8. Settlement of disputes: terms and conditions, set herein, shall be governed by the laws of India only. All disputes arising under the terms and conditions subject to the exclusive jurisdiction of the competent courts in Mumbai only. All claims and disputes arising under the terms and conditions should be notified to UNIT within 180 days after which no member shall have any claim against UNIT.

9. UNIT shall have no liability whatsoever for delays or interruptions of services or other breach of these Terms of Use due to fire, explosion, lightning, power surge or failure, water, acts of God, war, civil disturbance, terrorism, acts or omissions of communications carriers, or other causes beyond UNIT’s reasonable control.

10. All reasonable efforts would be taken by UNIT to ensure that MCC reward requests are fulfilled within 12 days of the receipt of the same at the call center or otherwise. UNIT will not be liable for any delay beyond the time period specified herein.

11. All requests issued for MCC rewards/donations are subject to any statutory regulations, rules and restrictions, if any.

VIII Termination of MCC membership

1. A member may terminate his/her MCC membership by calling the call center of the UNIT and requesting for termination.

2. Misuse of MCC card or the membership benefits may result in termination of membership or withdrawal of benefits at the sole discretion of UNIT.

3. Disqualification of a member, arising out of his/her misconduct, fraud and misuse of MCC rewards or acts in a manner contradicting with any central/state/local laws, statutes or ordinances, may result in immediate termination of MCC membership and cancellation of all MCC points and MCC rewards.

4. Upon the death of a member, his/her MCC membership account will be closed and all outstanding MCC points will lapse.

IX Miscellaneous

1. Settlement of disputes shall be governed by the laws of India only. All disputes arising under the terms and conditions subject to the exclusive jurisdiction of the competent courts in Mumbai only. All claims and disputes arising under the terms and conditions should be notified to UNIT within 180 days after which no member shall have any claim against UNIT.

2. UNIT shall have the right to transfer, assign and sell in any manner, in whole or in part, MCC to any party of its choice without reference or intimation to the members.

3. UNIT reserves the right to disqualify any person from further participation in MCC if in UNITs’ sole judgment such person has violated the terms and conditions specified herein.

4. UNIT reserves the right to terminate MCC, by giving one month's notice. Upon termination or withdrawal of MCC, all members will be given appropriate time within which they may use the MCC points in their account to request for MCC rewards or donations after which the MCC points will lapse.

5. UNIT and MCC merchants shall not be liable to any member or his/her nominee or companion, for any indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with MCC, including the functioning of the helpline and/or the website, and/or provision or the refusal to provided any benefits, whether such loss, damage or expense is caused by the negligence or otherwise, and whether UNIT and/or any of its MCC merchants have any control over the circumstances giving rise to the claim or not.

6. Customer must always carry the MCC card securely and should not share the information pertaining to his MCC membership with anyone.

7. MCC will not ask for customer password and other details through any e-mail or SMS. Please do not share your account details with unauthorized sources.

XI REG SMS lucky draw T&Cs

1. This offer is applicable for only those members who have received the communication regarding the said offer.

2. Only 3 lucky winners will win a movie voucher worth Rs.300/-.

3. The winners will be determined by a lucky draw mechanism.

4. Individuals need to register their Mumbai Community Card using prescribed means only to enter the lucky draw.

5. The MCC cards have to be registered on or before 31st May 2010.

6. Cash supplementation by members is not allowed. Members cannot claim cash in lieu of movie vouchers.

7. Movie tickets shall be of any show available at www.bookmyshow.com within the validity period of the voucher.
